I hope You are all well, safe.
It was defiantly most challenging six months, since the 24 of February of this year when an unbelievable military conflict took place in our native lands. It is still hard to believe that brothers continue to kill each other, and my Second Motherland – Italy among others continue to supply the deadly weapons. I am praying everyday for both sides’ victims, obviously Nazis and torturers excluded.
My Native Odessa is of the main strategic interest for the dominium on the Black Sea, and unfortunately and to our horror, sooner or later the events will most likely reach the place where people dear to me live, who, due to age or other circumstances, did not want to leave.
Little has changed in our legal situation.
On 25 April 2022 we applied to the Judicial Committee of The Privy Council asking to re-open their own decision of 10 November 2021. We outlined that 7 out of 30 rights contained in the Universal Declaration of Human Rights UN (1948) were violated in our case. And regarding the second part for the dismissing order we believe we healed this error by asking the permission in the Court of Appeal on 4 April 2022.
As for the US claim – we accusing UBS on producing in 2018 false records of our trades in the United States Regulated Exchanges – NYSE and NASDAQ. If for any person of goodwill it is obvious that this is a federal crime which has violated the law, conjured thousands of market participants and people working for the markets in the United States, UBS applied to dismiss our case as forum non conveniens and time barred. We are now awaiting the decision of the Judge of the Southern District Court of New York if to dismiss our Third Amended Complaint supported my Affidavit, both of 2 March 2022.
We hope that in both Courts, London and New York, Justice will prevail. Which of course will benefit not only us but public at large, as well as rights of all self-directed traders who may ever thought to have a loan from their broker or been outside of the United States to place trades in The United States Regulated Exchanges.
As for Bahamas – no trial date as yet, which was vacated on 23 September 2019 on the UBS’ application with only one “ground” – they do not have even one witness. They still don’t have, and we are still homeless, 4 years and 4 months and one week, with day-to-day fight for survival, without any decent capital to trade and our immigration status is without rights to be engaged in any gainful activity locally. Our children childhood is “ornamented” by these devastating eight years of the legal ordeal.
